The Collaborative Method
in Probate Cases

Probate Collaborative Law Method: Probating an estate will always necessitate the filing of pleadings and hearings before the court.  The Texas Probate Code provides for a family settlement agreement that affords parties in a probate proceeding to negotiate and compromise on almost all issues, whether property or procedure, in a probate case. The collaborative process is and has been very successful in creating settlements between parties, that is interest based and preserves a future relationship between those parties.  Probate proceedings, like Family Law, often involve families or extended families and the complications that arise with these longstanding relationships.  In most cases the parties have an interest in preserving these relationships, or have no choice other than trying to preserve the relationships they have with the other parties.  The option to preserving relationships and create a solution to a case that is in line with all the parties’ interests can create an “added benefit” to a case that may not be obtainable in a litigated case.  After the Collaborative Law Agreement is signed by all parties, 100 % of the effort from all the professionals and all the parties is spent obtaining a settlement and agreement between the parties that meets each parties’ own interests to the extent possible with in the agreement.
