Our Philosophy on
theLitigation Method

In most if not all civil cases the “fight” is the enemy. This is especially true in Family or probate/guardianship matters. The cost in money, emotion, and lose of future relationships is rarely worth the fight. After a trial where a Judge or Jury tells the parties how the property will be split, who will get what rights, and/or that there will be no repayment for the emotional cost, the parties are left with a result that generally leaves the perceived looser just waiting to get even. This is generally the worst thing that can happen to a family, even if this family is now split by divorce or death. Getting 60% of a pie that is 50% smaller, due to the fight, is less than 50% of the whole.

However in those cased that have to go to Court, the suit must be pursued vigorously, and timely. Taking the time to properly prepare for a case is essential, but letting a case go any longer than the preparation time is costly. In Court it is not what you know, it is what you can prove, that is important. Preparation and the marshaling of evidence to prove your case is the corner stone of obtaining a good result in trial and should be pursued aggressively. There are always unavailable delays in scheduling with the parties and the Court, so any other delays that can be controlled should be eliminated.
