Types of Guardianship in Texas

In order to establish guardianship, the following must be proven:

  • That the person in question is incapacitated due to age, mental disabilities, or physical disabilities
  • The level of protection and care that the individual needs
  • That the individual seeking the guardianship is qualified to act as guardian

Two types of guardianships include:

  • Guardianship of the person: With an adult person, it is used when the individual is incapacitated due to physical or mental disabilities and is need of assistance to care for their person. With a minor person, it is only available for an orphan.
  • Guardianship of the estate: For an adult or minor person, this is used when an individual is incapacitated due to age, physical or mental disabilities and is in need of assistance to care for their property – both real and personal.
